Religion and Criminal Justice

After reading this week’s text that pertains to divine command theory and moderate divine command theory I believe the difference between the two is how much a person relies on divine command theory. An example of absolute divine command theory would be some Islamic societies in the Middle East who practice a strict law directly out of their holy book the Koran. And a moderate example of divine command would be far less traditional Islamic communities that recognize western influences.

When it comes to religion influencing the making of laws we can look at the history of the world. Some can argue that the United States has laws that are derived from the Ten Commandments. However we live in a free country and the constitution protects us citizens from religious prosecution and religion being forced upon us all. So when it comes to religion influencing laws I would say it never should, however morality and ethics a reasonable person maintains shares a close resemblance to relegation.

To use religion as a way to rehabilitate is a move in the right direction for example introducing a non-believer who is an addict to religion and teaching them to use religion to help them in their struggle, I would argue there is no ethical reason why not to. To use religion to rehabilitate by striping that person of their own free will and is in my opinion un-ethical. An example of this would be in the early 1900’s Irish family would sent their “problem citizen” to work in this religious type boarding prison in hopes they could work their way in to heaven by paying off their sins though work for the church.  

Religion and criminal justice work in hand especially when dealing with criminal cases. The main reason for this is because all laws applied in the bible have been used to guide and protect citizens in different countries like America. In your post you posted some negative and positive effects concerned with religion and criminal justice. Positive effects related to the post. Many people argue that the laws governing American government are derived from the Ten Commandments in the bible. This might not be the exact assumption because the laws are made to cater and protect human rights in the country (Williams, & Arriago, 2012). You did a great job in your post encouraging people to use religion and to encourage others from doing evil things.  Additionally, people in America do not attendant jobs in Sundays. Relating to the Ten Commandments, there is a law which says that people should keep the Sabbath day holy. For this reason, the positive side of the positive is encouraging people to keep religion in the fore front in their life struggle.

Islamic religion has been using religion to handle some cases in their community. Many people have been converted to Islamic because they have been following correct measures for developing their country. This is the reason why many people have used religion to rehabilitate people to move in the right direction. It is true to say that the post encourages people to use religion to rehabilitate people such as introducing non-believers to use religion for them to prosper in life because religion is full of wise words which are important. You also encourage us to use religion to rehabilitate people would have wronged and this would encourage them to use religion in their life struggle.

Alternatively, the post also has negative effects related to criminal justice. For example, sending people to prison to pay for their sins would not be important because many people have families which they need to take care off. For this reason, sending them to prison would diminish their developments and this would be ironical according to the Ten Commandments. On the other hand, some Islamic in the Middle east practice strict laws directly from their holy book the Koran which might not favor the  entire community because each religion has its own holy book (Williams, & Arriago, 2012. For this reason, some laws may affect negatively on some people because they use different ideas from their religion. Therefore, each religion should use God’s way to rehabilitate those people who have wronged through using indirect laws from the bible or holy book. Through this, people would grow up spiritually and avoid immoral behaviors.
